Terms of Service

1. The Service

ShowUp lets users create and join habit/accountability challenges, invite others, submit check-ins with photo or note proof, track streaks, interact socially (friends/feeds), and receive notifications.

We may update, add, or remove features. We do not guarantee uninterrupted or error-free operation.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your country) to use ShowUp. If you are under the age of majority where you live, you represent that you have parental/guardian consent where required.

3. Accounts

• You must provide accurate information and keep your login credentials secure.
• You are responsible for activity under your account.
• One person should generally use one account.
• We may suspend or terminate accounts that violate these Terms or create risk/abuse.

Sign in with Apple and email/password authentication may be available depending on platform.

4. Your content

“User Content” includes profile info, challenge details, check-ins, photos, notes, invites, and other materials you submit.

You retain ownership of your User Content. You grant ShowUp a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your User Content as needed to operate and improve the Service and as required by your visibility settings (for example, showing proof to challenge members or public viewers).

You represent that:

• you own or have rights to the content you post
• your content does not infringe others' rights
• your content complies with these Terms and applicable law

We may remove content that violates these Terms or creates legal/safety risk.

5. Social features and visibility

Because ShowUp is social, other users may see your profile, challenge activity, and proof according to challenge and privacy settings. Public/discoverable challenges may appear in feeds. Invite links may expose challenge information to recipients. Use discretion before posting photos or personal information.

6. Acceptable use

You agree not to:

• harass, threaten, bully, or abuse others
• post illegal, sexual/exploitative, hateful, or violent content
• post others' private information without permission
• impersonate anyone or misrepresent affiliation
• upload malware or attempt unauthorized access
• scrape, reverse engineer, or disrupt the Service
• use ShowUp for spam, scams, or deceptive invites
• interfere with streaks/check-ins through fraud or manipulation that harms others' experience
• use the Service for any unlawful purpose

We may investigate and take action, including content removal and account suspension/termination.

7. Invites and contacts

If you invite others (including via contacts), you confirm you have a legitimate reason to contact them and will comply with applicable messaging/privacy laws. Do not send unsolicited spam invites.

8. Notifications

With your permission, we may send push notifications (reminders, invites, social activity). You can disable notifications in device settings. Essential service emails (security/account) may still be sent.

9. Intellectual property

ShowUp's name, branding, app design, software, and non-user content are owned by ShowUp or its licensors. You may not copy, modify, or distribute our materials except as allowed by these Terms or with written permission.

10. Third-party services

The Service relies on third parties (for example Apple, cloud hosting/auth/storage, push providers). We are not responsible for third-party outages or terms beyond our reasonable control.

11. Disclaimers

SHOWUP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that using ShowUp will produce any particular habit, health, fitness, or life outcome. ShowUp is not medical, fitness, or professional advice.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOWUP AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 50.

Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.

13. Indemnity

You agree to indemnify and hold harmless ShowUp from claims arising out of your User Content, your use of ShowUp, or your violation of these Terms or law, to the extent permitted by applicable law.

14. Termination

You may stop using ShowUp and delete your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by nature should survive (including ownership, disclaimers, liability limits) will survive termination.

15. Changes to the Terms

We may update these Terms. Continued use after changes become effective means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

16. Governing law

These Terms are governed by the laws of Slovenia and applicable European Union law, without regard to conflict-of-law rules. Courts in Slovenia will have jurisdiction, unless mandatory consumer protections in your country say otherwise.
